Gender equality is the basic national policy of our country. Promoting equal employment for women is conducive to promoting women’s wider and deeper participation in social and economic activities and enhancing social productivity and economic vitality. The party and government pay high attention to the equal right to employment of woman under the protection of Labor Law, Employment Promotion Law, Women Rights Protection Law, etc, and have to issue specific regulation on gender discrimination in employment. The recent employment of woman is good in general as the participation in labor ranks the forefront worldwide although the bad effect still generates from some difficulties especially non-stoppable gender discrimination in employment. To further regulate the recruitment and promote the equal right to employment, hereby notice the following:
- Hold on to the general requirement. All the regions shall implement the basic national policy of gender equality under the guidance of the Xijinping new era Chinese character socialism and put importance on solving the employment gender discrimination as a big step in improving women employment quality, combining the importance with the general, soft mediation with the strong force, active promotion and legal punishment.
- Ban the employment gender discrimination in the recruitment. All the employers, institutions shall not set gender limitation or preference in the recruiting plan or news or in interview, and shall not inquire about a woman’s martial childbearing status, or ask new hires to take pregnancy tests, or set birth as a condition of employment, or set different recruitment standard. State owned enterprises, public human resource service institutes and other service institutions shall take the lead in observation of law and ban the gender discrimination.
- Strengthen the market supervision on human resource. Human resource inspection service institution shall be built to release thorough information and solve complaint, and review the recruitment information and correct unjust content in time to make sure the reality, legality, and effectiveness. An order to correct shall be issued to those employers that release the discrimination info; a fine of 10000 yuan to 50000 yuan shall be imposed if the order denied; human resource service institute might have license revoked under gravity circumstances. Employers and service institution releasing discrimination info would be taken in market credit record.
- Build alien negotiation system. Open the channels such as window reception, hotlines as 12333, 12338, 12351 etc, and accept the related complaint on time. Talk with the employers in issue, investigate and meditation though talk, negotiation and letter, etc to correct its discrimination and solve the dispute between the employee and employer on time. If the employer refuses to correct, it would be punished by law and released by social media.
- Improve legal remedy. Hear the litigation on gender discrimination and set the case on equality of employment, take active steps to provide legal aid to the discriminated female employee.
- Support Women Employment. Put importance on female university graduates and provide characteristic position introduction and build the right view on employment and career choosing. Organize fit training program, encourage the employers to development training for woman back from maternity leave to fit the job requirement. Improve the baby care for kids under 3-year-old, provide after-school service for primary and secondary school to release the burden of raising and balance the work and family for woman. Improving the maternity insurance system, play its role of protection. Strengthen the inspection and punish the tort of woman during pregnancy, maternity leave, lactation period. If any labor arbitration raised, it shall be heard as soon as possible.
- Provide public education and guidance. Stick to the equality between genders and erase the prejudice gradually. Provide more anti-discrimination propaganda on law, regulation and policy to guide the whole society respect woman and the employers observe the law and employees protect their own rights. We will create a social environment conducive to women’s employment and help women strive for self-improvement, fully develop their strengths and demonstrate their intelligence, wisdom and value in all walks of life.
- Strengthen organization leadership. All the regions, related departments shall pay high attention in improving the equality in employment. The human resource and social security department shall strengthen the inspection with other related departments, guide the recruitment on the legal and reasonable base, provide the employment service and technique training. The education department shall provide after-school service, legal department shall provide legal remedy and aid. The health department shall provide baby care service. The state property inspection department shall guide and correct the subsidies.
