Recently, the Ministry of Human Resources and Social Security has been seeking public comments for the Opinions on Issues concerning the Implementation of the Regulations on Work-related Injury Insurance (II) (Draft for Comment) (the “Draft for Comment”). The period for feedback will end on February 19, 2016.
The Draft for Comment puts forward that the work-related injury insurance policies shall apply to the employees who have reached or exceeded the statutory age for retirement, but fail to go through the retirement formalities or enjoy the basic endowment insurance benefits for employees in accordance with the law and continue to work for their original employers, and the employers shall undertake the work-related injury insurance liability in accordance with the law. The Draft for Comment also indicates that employers shall, in principle, cover the work-related injury insurance at their registration places; if they fail to do so, they may cover the work-related injury insurance at the location of their production and operation. Where a labor dispatch unit assigns its employees to work in other regions, it shall insure these employees against the work-related injury at the place where the employer is located in accordance with the law. Where a construction company covers the insurance on the basis of projects, it shall cover the work-related injury insurance at the place where the construction project is located.
